Information Clause of the "Your Startup" Entrepreneurship Development Foundation
The Administrator of your personal data is the "Your Startup" Entrepreneurship Development Foundation based in Warsaw (headquarters address: ul. Żurawia 6/12, lok. 766, 00-503 Warsaw).
Purpose of processing your personal data
We inform you that your personal data will be processed on the basis of the Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR) for the following purposes:
a. verification of the Contractor's authority to act on behalf of the Client, including verification of the above data in public registers, contacting you regarding the performance of the Agreement and as legitimate interests pursued by the Administrator (legal basis from Art. 6 para. 1 letter b and f of the GDPR). The data will be processed until the contract is fulfilled, and in terms of archiving them, until the claims are time-barred;
b. fulfilling all our legal obligations in connection with the cooperation undertaken (Article 6 (1) (c) of the Regulation), this purpose is related to legal obligations to store certain documents for the time specified in the law, e.g.:
• art. 74 par. 2 items 1-8 of the Accounting Act of 29.09.1994 (Journal of Laws of 2017, item 1858);
• art. 86 para. 1 and 2 of the Tax Ordinance Act of 29 August 1997 (Journal of Laws of 1997, No. 137, item 926).
c. possible determination, investigation, or defense against claims, which is our legitimate interest (legal basis from Art. 6 para. 1 letter f of the GDPR). The data will be processed until the claims are time-barred.
Source of data
Your data has been collected directly in connection with the pursuit of the contract or provided by the Contractor, who is a party to it.
Rights of the data subject
a. The right to access personal data processed by us (Article 15 of the Regulation);
b. The right to rectify entrusted personal data, including their correction (Article 16 of the Regulation);
c. The right to erase personal data from our systems, the so-called "right to be forgotten" - if you believe that we have no basis to process your data, you can request that we delete them (Article 17 of the Regulation);
d. The right to restrict the processing of personal data - you can request that we limit the processing of personal data solely to their storage or to perform actions agreed with you, if we have incorrect data about you or process them unlawfully; or if you do not want us to delete them because you need them to establish, investigate or defend claims; or during the time of objection to data processing (Article 18 of the Regulation);
e. The right to data portability - You have the right to receive from us in a structured, commonly used, machine-readable format (e.g. ".csv" format) personal data concerning you, which we hold based on a contract or your consent. This entitlement will be exercisable only if the processing of your data is carried out by automated means (Article 20 of the Regulation).
a. Right to object - you can object to the processing of your data if the legal basis for the use of the data is our legitimate interest - Art. 21 of the Regulation. In such a situation, after considering your request, we will no longer be able to process the personal data covered by the objection on that basis, unless we demonstrate the existence of legally justified grounds for processing the data that are overriding your interests, rights, and freedoms;
b. If you believe that the processing of your personal data violates the provisions of the Regulation, you have the right to lodge a complaint with the supervisory authority, i.e. the President of the Personal Data Protection Office.
Recipients of your data:
a. Public authorities, to the extent that they do not receive data in the course of specific proceedings based on the law;
b. Entities that process your personal data on behalf of the Foundation based on a data processing agreement concluded with the Foundation (so-called data processors) or authorized persons. These may include, among others: Foundation beneficiaries, IT specialists, archiving companies, entities providing banking and payment services, hosting companies, employees, and associates;
c. External data administrators (so-called Parallel Administrator, to whom the data is made available, e.g. legal advisors and attorneys, courier or postal companies, debt buyers - in case of non-payment of our invoices on time).
Profiling:
Please be advised that your data will not be subject to profiling, which means the automated analysis of your data and the development of predictions about your preferences or future behavior (profiling means, for example, in the case of marketing profiling, determining which offer you may be most interested in based on your previous choices).
